An uncontested divorce can be a relatively straightforward process, requiring no court appearance and concluded within weeks. On the other hand, a contested divorce can take over a year or more and require multiple hearings. I find my clients are usually best served by concluding their divorce cases as simply as possible, but I do not hesitate to litigate when necessary to defend my clients' interests.
Your relationship with your children is more important than virtually everything else in life. The system seeks to support the ability of children to have a loving relationship with both parents, where appropriate, but can be frustrated by a party acting in bad faith. When disputes over the custody, visitation, or support of children are not part of a divorce suit, the matter is usually handled in the Juvenile and Domestic Relations District Court. A court-appointed guardian ad litem is often tasked with representing the children's interests and making recommendations to the court. These cases can take months or even years as the parties return to court several times to review the appropriateness of custody arrangements. The children, whose interests should be the focus, are often best served if the parties can set aside their disputes and work collaboratively. Unfortunately, that isn't always possible.
If you are arrested or accused of a crime, remember: Assert your right to remain silent, and ask to speak to an attorney. Do not speak about the incident with anyone other than an attorney; unless they are covered by an evidentiary privilege they could be subpoenaed to testify against you.
